These Terms and Conditions (hereafter "Terms") govern your use of Fabspot UK’s services, including the use of Fabcards and the participation of businesses offering deals through our platform. By using our website or purchasing a Fabcard, you agree to be bound by these Terms. Please read them carefully.

Fabcard Holder Terms and Conditions

1.1 Fabcard Membership

  • By purchasing or subscribing to Fabcard, you gain access to exclusive offers and discounts from participating businesses.

  • Fabcard is non-transferable and must only be used by the cardholder registered with Fabspot.

  • You must present your digital Fabcard at the time of redemption. No screenshots or printed versions of the Fabcard will be accepted.

1.2 No Refund Policy

  • All Fabcard purchases are final. No refunds will be issued once the card is purchased, regardless of whether it has been used or not.

  • Subscriptions to Fabcard can be cancelled at any time, but no refunds will be provided for partial periods.

1.3 Unlimited Redemptions

  • Fabcard holders can redeem offers an unlimited number of times at participating businesses unless otherwise stated by the specific business.

  • Offers are subject to availability and may vary at the discretion of the business.

1.4 Liability Disclaimer

  • Fabspot is not responsible for the quality of goods, services, or dining experiences provided by businesses offering Fabcard discounts. If a business’s service or product quality is unsatisfactory, this is solely a matter between the cardholder and the business.

  • Fabspot holds no liability for any disputes, damages, or losses that arise between Fabcard holders and third-party businesses.

Business Terms and Conditions

2.1 Adding Offers

  • Businesses can add offers to the Fabspot platform free of charge.

  • The business is responsible for honouring the offer as described on the platform. Fabspot reserves the right to remove or suspend any offers that do not meet the platform’s standards or are reported by Fabcard holders as misleading or inaccurate.

2.2 Offer Control

  • Businesses maintain full control over their offers, including the ability to update or cancel them at any time. Changes to an offer will not apply retroactively to any Fabcard holder who has already made a booking or redeemed an offer.

2.3 No Liability for Offers

  • Fabspot is not liable for any loss of revenue, profits, or reputation caused by participation in the Fabspot platform.

  • Fabspot holds no responsibility for disputes between businesses and Fabcard holders.

2.4 Business-Customer Disputes

  • If a Fabcard holder disputes the quality of goods, services, or experiences provided, Fabspot is not responsible for mediating or resolving the dispute. This remains a matter between the business and the customer.

Employers Purchasing Fabcards for Employees

3.1 Bulk Purchases

  • Employers purchasing Fabcards on behalf of their employees may do so via our bulk purchase system.

  • Once purchased, Fabcards are non-refundable, regardless of usage. There is no refund or cancellation once cards have been distributed to employees.

3.2 Employee Use

  • Fabcards purchased for employees are to be used solely by those employees and are non-transferable.

  • Employers are responsible for informing their employees of the terms and conditions associated with the use of Fabcard.

4. General Terms for All Users

4.1 Fabspot’s Role

  • Fabspot acts solely as an intermediary between cardholders and businesses. We are not a party to any transactions between you and the participating businesses and bear no responsibility for the service or quality of goods provided.

4.2 Modifications to Services

  • Fabspot reserves the right to modify or discontinue any services at any time without prior notice, including altering or discontinuing offers or promotions on the Fabspot platform.

  • If we terminate or suspend any part of the service, we will endeavour to notify users, but this may not always be possible.

4.3 Limitation of Liability

  • Fabspot will not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use Fabcard, even if Fabspot has been advised of the possibility of such damages.

  • Our total liability to you, whether in contract, tort, or otherwise, shall not exceed the total fees paid by you to Fabspot in the preceding six months.

4.4 Data Protection

  • Fabspot complies with applicable data protection laws, including GDPR. Your personal data will be handled in accordance with our Privacy and Cookies Policy.

  • By using Fabspot, you agree to the processing of your data as described in our privacy policy.

4.5 Cancellation of Offers and Services

  • Fabspot reserves the right to cancel or suspend any user’s Fabcard or a business’s participation in Fabspot without prior notice, for reasons including but not limited to violations of these Terms, misuse of services, or fraudulent activity.

5. User Conduct

5.1 Prohibited Activities

  • You must not misuse our platform by interfering with its normal functioning, attempting to access it without authorization, or violating any applicable laws.

  • Any fraudulent or abusive conduct related to the use of Fabcard, such as the unauthorized distribution of offers or abuse of our platform, will result in the immediate termination of your account without refund.

5.2 Termination

  • Fabspot reserves the right to terminate any user’s access to the platform at its discretion. If your Fabcard or business account is terminated, you are prohibited from re-registering without our explicit consent.

6. Governing Law and Dispute Resolution

6.1 Governing Law

  • These Terms are governed by the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
