Terms and Conditions
Please read these terms and conditions ("Terms", "Terms and Conditions") carefully before using the Fabspot Fabcard and associated mobile application (the "Service") operated by Fabspot Ltd ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Offer Listings & Terms and Conditions Tab
a. The Service provides listings of offers within the app along with separate tabs for Terms and Conditions associated with each offer.
2. Customer Checkout & Registration
a. Users must complete the Stripe checkout process to become paying customers. b. Successful checkout registers the user as a Fabcard holder using the same email for app login.
3. Fabcard Holder Access & Offer Exploration
a. Registered Fabcard holders have access to explore all available offers within the app.
4. Geo-Location-Based Push Notifications
a. The Service uses geo-location recognition to send push notifications to the locked screen when the user is within a specified area. b. If the app is open, a related banner is displayed for the recognised offer.
5. Interaction with Notifications/Banners
a. Tapping the notification or banner directs the user to a specific card page displaying the relevant offer. b. This card page includes the customer's name and concise details. Screenshots are prohibited for security purposes.
6. Discount Tracking and Usage
a. User interactions with offers are tracked to monitor the number of discount openings. b. This tracking facilitates future plans to limit discount openings for certain customer pricing tiers.
7. Payment Failure Handling
a. In case of a payment failure through Stripe, customers are notified through Stripe's notification system about the failed payment. b. Notification indicates an attempt to charge the payment again within (7) days if the initial payment fails. c. If the payment fails repeatedly after the specified duration, the app is notified to close the account. d. Account closure due to repeated payment failures initiates cancellation of the associated Fabcard.
Prohibited Activities
a. Any attempt to abuse the app, fraudulently access offers, or share login information with unauthorized persons is strictly prohibited. b. Violation of these terms may result in fines up to £1000 and immediate termination of access to the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
